Plaintiff, a minor, suing by his next friend and father, failed by a verdict of the *402jury to recover damages against defendants Lonnie Thomas and Redwing Carriers, Inc., for personal injuries which he sustained when struck by an automobile driven by Miss Martha Ann Ross (not a party defendant) immediately after he alighted on a public highway from a tractor (pulling a trailer recently emptied of gasoline) owned by Redwing Carriers, Inc., and driven by its agent or servant, Lonnie Thomas.
