On tbe seventeenth of May, 1867, L. G. Luminais, administrator of L. E. Maxon, filed a petition in the Second District Court of New Orleans, alleging that the widow Marie E. de Gréhan died in France on the twentieth of December, 1864, leaving two children, one of age and the other a minor, her sole heirs, and that the succession consists of real property situated in the city of New Orleans. *365He alleges that lie is a creditor of the succession.
