MEMORANDUM
DAVIS, District Judge.
Presently before the Court is Defendants’ Motion to Dismiss (Doc. No. 9) and Plaintiffs’ Response (Doc. Nos.10, 11). For the Reasons that follow, Defendants’ Motion (Doc. No. 9) is GRANTED in part and DENIED in part.
I. Background
There are two plaintiffs in this action, Gianna Diaz and Henry Peralta. According to the Complaint, Diaz received a telephone call in June 2006, from an unknown caller who warned her that he would, within hours, “repossess all of her household belongings and even her car.” (ComplJ 12.)
