— The complaint in this case contains three causes of action. The first cause is for labor and services performed by James A. Gilbert, the husband of the plaintiff, at the defendant’s special instance and request, at an agreed price of $50 per month, no part of which, it is alleged, has been paid. The plaintiff alleges that she was at all the times mentioned in the complaint the qualified and acting administratrix of the estate of James A.
