Appeal from Appanoose District Court. Plaintiff brought this action to recover possession of a strip of land one hundred feet in width through a certain forty acre tract. She alleges in her petition that she is the owner of said strip of land, and that she is entitled to the possession thereof, and that defendants unlawfully keep her out of possession theieof. The defendants in their answers deny plaintiff’s ownership and right of possession of the premises.

It appears from this finding that the mortgage, to Murray ° ¶’ & J was executed April 18, 1878. The conveyance A 1 J *° Artis was given October 8, 1878. The suit to foreclose the mortgage was instituted December, 20, 1879, and John Artis was made a party to that suit.
