BLATCHFORD. District Judge.
This suit is founded on re-issued letters patent of the l.'nited States, granted to Samuel P. Kittle, one of the plaintiffs, October 17th, 1865, for a “spring mattress.” on the surrender of original letters patent granted to him November Sth, 1864. The re-issued patent contains seven claims, but only the first two claims are alleged to have been infringed by the defendants.
