Plaintiff, Louis Carlesimo, brought this action against The Feldheym Company, Incorporated, a corporation, Dave Schwebel, an individual, Jesse Feldheym, an individual, and The Schwebel Company, a copartnership, for damages for the breach of a contract to sell to plaintiff two carloads of tomato paste. The damages were alleged to consist of a $3,125 deposit made by plaintiff, and $14,125 loss of profits.
