Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Comptroller *744which denied petitioner’s request for a redetermination of his retirement status.

Petitioner, formerly Chief of Police of the Village of Scars-dale in Westchester County, received some $5,830.86 for overtime work performed in 1983.
