Proceeding pursuant to *1063CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of respondent which excluded certain sums from its computation of petitioner’s final average salary. Petitioner is a member of respondent New York State Employees’ Retirement System and was employed as village attorney by the Village of Mexico, New York, and as school attorney by Mexico Central School District No. 1 for many years until he retired from these positions at the end of 1973 and applied to respondent for his retirement…
