Rose Tarnowski, plaintiff, brought; suit against Eugene Fite, defendant, the owner of a taxicab which on the 24th day of June, 1946, was being driven up Second avenue, in the city of Highland Park, Michigan, by one of his employees. Plaintiff, who was a passenger for hire at the time, testified that as the cab reached LaBelle avenue the driver was proceeding at a speed of from 38 to 42 miles an hour; that as he approached close to a car which had stopped ahead, he applied the brakes so as to bring the cab to a stop.
