The defendant has moved to suppress testimony identifying him as the perpetrator of the crime on the ground that he "was subjected to an impermissibly suggestive corporeal identification procedure” which was "so conducive to an irreparable mistaken identification as to be a denial of due process of law”. The People respond that the identification testimony in this case involves two confirmatory viewings by an undercover police officer which are "not identification procedures within the ambit of Wade and its progeny”.
