In this real action, the demandant claims to recover an estate in fee simple in certain lands in West Gardiner by virtue of a levy thereon, in August, 1877, of an execution in his favor and against the defendant. The premises levied on and demanded were coixveyed to the defendant described as trustee by deed of warranty from William W. Clark, in September, 1871. The deed contains no description of the nature or pur*298poses of the trust, but designates the grantee, the defendant, as trustee, and runs to him, his successors and assigns.
