FACTS AND PROCEDURAL HISTORY

This motion for summary judgment brought by the defendants is a phase of a complicated employment discrimination lawsuit alleging violations of 42 U.S.C. § 1983, 42 U.S.C. § 2000e et. seq. (“Title VII”), 1 and N.Y. Executive Law § 297(9).
