Appeal by defendant from an order of the district court for Bamsey County, Simons, J., presiding, refusing a new trial, after a verdict ■of $5,000 for plaintiff. The action was brought, under the statute, for damages for injuries causing the death of plaintiff’s intestate.

The decision upon a former appeal in this action is reported in 30 Minn. 215. The fatal injury for which this action was brought occurred while the deceased was in charge, as a conductor, of a freight train of the defendant, running from Minneapolis'to Albert Lea. The ease before us fairly presents these circumstances ■attending the accident, and the probable theory of its cause here suggested: The train consisted of a locomotive and a long train of freight cars,' with a caboose in the rear.
