July 80, 1931, plaintiff filed its petition against defendant to recover fees in excess of his statutory salary for 1920 to 1924, earned by defendant as clerk of the district court and unaccounted for to the total amount of $2,732.40. One paragraph of the petition contained a schedule in which appeared, opposite each of the five years above named, the fees earned by the office, the amount paid over to the county treasurer and the balance due the county.
