This is an application for a stay of execution pending an appeal from a judgment of death. The defendant, Isaac N. Harrell, was indicted July 5, 1910, for the crime of murder in the first degree, alleged to have been committed in Lake County by killing Walter Newell. A motion was filed to set aside the indictment on the ground that it was not found, indorsed, or presented as required by law, in that the grand jury returning the same had no authority to inquire into the commission of the crime charged because the court on May 12, 1910, adjourned without designating any day for…
