The accused in this case, Private Louis E. Bondar; United States Army, was tried by general court-martial on a charge of desertion in violation of the Uniform Code of Military Justice, Article 85, 50 USC § 679. He was convicted, instead, of the offense of unauthorized absence in violation of Article 86 of the Code, 50 USC § 680. The findings and sentence were set aside and the charges were ordered dismissed by the board of review.
