CHRISTIAN, Judge.

The offense is assault with intent to murder; the punishment, confinement in the penitentiary for nine years.

The opinion on former appeal is found in 19 S. W., Second Series, at page 319. We deem it unnecessary to again detail the evidence, as the testimony adduced upon the present trial was practically the same as that found in the record on the former appeal. Reference is made to Cotton v. State, supra, for a statement of the evidence. In affirming the case on the original hearing on the former appeal, the evidence was deemed sufficient to sustain the con viction. Our…
