The libellant has been legally married to a wife, who is still living. He was guilty of deserting her, and for this cause she obtained a divorce against him from the bond of matrimony. By Gen. Sts. c. 107, § 25, in cases of divorce from the bond of matrimony the innocent party may marry again, as if the other party were dead. In case of any marriage contracted by the guilty party during the life of the other party, except as provided in the following section, he shall be adjudged guilty of polygamy.
