Thompson and another, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 18th day of June, 1903, upon the decision of the court rendered after a trial at the Kings County Special Term.

■ This action is in equity to compel specific performance by the defendants of a contract requiring the issue and delivery to plaintiff of certain shares of the capital stock of the defendant corporation. The contract was for the personal services of the plaintiff, to ■be paid for in part by the issue and delivery to him of the stock in question, which services the court has found to have been fully performed by him and to have been terminated by his unjustifiable-discharge from the defendants’ employment.
