HOWARD, Judge.
The state has brought this appeal to challenge the juvenile court’s dismissal of its petition for adjudication of dependency in this action. We reverse and remand for proceedings in accordance with this opinion.
On March 20, 1981, appellee mother took her six-year-old son to the emergency room of the Copper Queen Community Hospital in Bisbee, Arizona. He was not breathing, and was pronounced “dead on arrival” after efforts to restore life functions failed.
