0. B. Taylor, plaintiff in error, was the owner of land in Sumner County and conveyed it to C. R. Mitchell, one of the defendants in error. To secure part of the purchase price, Mr. Mitchell executed to Mr. Taylor a mortgage upon the land for thirty-five hundred dollars. The deed was recorded in Sumner County, but the mortgage was not recorded until after several subsequent conveyances and mortgages had been executed upon such land and recorded.
