The correctness of the lower court’s action in sustaining a demurrer filed by appellee to appellant’s declara tion is the sole question, presented by this appeal. The judgment appealed from was entered against appellant, plaintiff below, after he had declined to file an amended declaration.

Appellant, as trustee under an assignment made, in pursuance of an order passed by the Orphans’ Court of Frederick County, by the executor of Leonard R.
