DAVIS, District Judge.
This action was instituted on December 19, 1963 by the plaintiffs who filed a complaint against The Penn Supply and Metal Corporation, hereinafter referred to as “Employer”, and Laborers’ District Council of the Metropolitan Area of Philadelphia and Vicinity, International Hod Carriers’ Building and Common Laborers’ Union of America, AFL-CIO, Local 57, hereinafter referred to as the “Union”.
