In an action, inter alia, to recover damages for false arrest, *796the plaintiff appeals from an order of the Supreme Court, Queens County (Hart, J.), dated June 26, 2007, which, in effect, sua sponte, dismissed the action.
Ordered that on the Court’s own motion, the notice of appeal from the order is treated as an application for leave to appeal, and leave to appeal is granted (see CPLR 5701 [c]); and it is further,
