These cases are before the Court on Plaintiffs’ Motions for Class Certification. For the reasons hereinafter set forth, the motions are GRANTED.
I Preliminary Statement
These cases allege causes under federal law and for breach of contract under state law concerning the amount of interest paid in certain loan transactions. Plaintiffs Kleiner and Morosani executed various notes calling for interest to be paid at a specified percentage above the “prime rate,” which allegedly was defined in the notes as the rate charged to the Bank’s best and most creditworthy…
