OPINION
LYDON, Judge:
This contract case is before the court on defendant’s motion for summary judgment and plaintiff's opposition thereto. Defendant maintains that no issue of material fact exists and that it is entitled to judgment as a matter of law. Plaintiff argues that there are issues of material fact in dispute. The dispute in this case focuses on the enforceability of a liquidated damages provision in a contract between plaintiff and defendant for the sale of certain property after plaintiff failed to complete the purchase as agreed.
