INTRODUCTION

This matter is before the Court on the motion of the debtor to permit assignment of all the debtor’s interest in a contract for deed with Powder House Lodge, Ltd. The contract for deed states that the vendor-seller (Powder House Lodge, Ltd.) will consent to an assignment of the contract for deed, provided the vendee-purchaser (debt- or) pays an assumption fee of four percent of the remaining outstanding balance due on the contract.
