This is an action for the alleged conversion of wheat of the value of $1,625.47. The tidal court sustained a demurrer to plaintiffs’ petition, and they have appealed. The question before us is whether the petition states a cause of action.

Plaintiffs, who were the owners of 560 acres of land in Gove county, on September 18, 1926, entered into a written contract to sell it to Adam E. Geist, on what is spoken of as the “crop payment plan,” for the sum of $18,200. By the terms of this contract Geist agreed to buy the land for the sum stated and…
