Plaintiffs, Eugene L. and Florence Eldredge, sued for damages based upon personal injuries and property damage suffered by them as the result of an automobile accident occurring on the Pacific highway a few miles north of Seattle, between ten and eleven o’clock on the morning of November 11, 1933.

The highway consists of two paved strips, each twenty feet in width, separated by four feet of gravel. At the place the accident occurred, the highway slopes slightly down grade toward the north; and on its easterly side is a dirt shoulder approximately eight and one-half feet in width, to the east…
