Appellee Hubard, who was plaintiff below, filed his bill against Herzog (appellant), Deslauriers Steel Mould Company, Inc., the Secretary of the Treasury, and the Treasurer of the United States. The bill alleged that Herzog had contracted with the United States for the erection of a building at St. Elizabeth’s Hospital in the District of Columbia; that Deslauriers Company was a subcontractor of Herzog; and that Hubard at the request of Deslauriers Company furnished lumber to it which was used in the work; that Herzog guaranteed payment by Deslauriers for the material but that payment had not…
