This spit was brought by Hhe appellee for the recovery of the value of certain animal's killed by ithe appellant, about August 31, 1895, the petition alleging thalt the appellant had negligently permitted the fence which inclosed its track and roadbed to get -in a bad condition, so as to be entirely insufficient to turn ithe stock or to keep them from entering -the right of way, and negligently constructed t-he crossing over its track and right of way, and failed and neglected to construct cattle guards at said crossing so as to turn stock therefrom, so 'that the…
