The complaint in this case states two causes of action, in each of which it is alleged that the defendants are copartners doing business under the firm name and style of Stables of Registered Stallions.

In the first cause of action the plaintiff alleges that, between the first day of May and the thirty-first day of August, 1917, the defendants employed him to sell stallions for them, and agreed to pay him as a compensation ten per cent of the amount of sales made, and in addition thereto such expenses as he necessarily incurred; that he sold certain stallions, and incurred expenses in that…
