ELLIS, District Judge.

The matter is before the Court on petitioner’s motion to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255.

Petitioner and three co-defendants were charged in a seven-count indictment with offenses arising out of the prison murder of a fellow inmate at the medium security facility at the District of Columbia Department of Corrections Facility in Lorton, Virginia. The evidence introduced at trial showed' that petitioner and his co-defendants attacked the victim outside of their dormitory. Eyewitness accounts stated that one of the co-defendants…
