This is a motion by the defendant Morris E. L. Shapiro for summary judgment. The plaintiff’s action is to recover for legal services rendered to the defendant’s wife as necessaries.
The plaintiff, an attorney, claims that he was retained by defendant’s wife to apply for a modification of a separation decree so that it would provide for the reimbursement of medical bills incurred by her and about to be incurred by her in connection with a terminal illness from which she was suffering.
