This appeal arose from a Superior Court action brought on behalf of the plaintiff, the Estate of John E. Braswell, by the decedent’s wife, Josephine Braswell, as executrix, whereby following a jury trial the defendant, The People’s Credit Union, was held liable for negligent misrepresentation and the plaintiff was awarded $7,686. The defendant avers that the trial justice erred in denying the defendant’s request to charge the jury on the theory of comparative negligence.
