PHILLIPS, Circuit Judge.

An indictment containing two counts was returned against Morris Rosenbloom in the United States District Court for the Western District of Texas at the May, 1941 term of such court. The first count charged that Rosenbloom, on or about March 13, 1941, in such District, unlawfully entered the Alamo National Bank of San Antonio,'Texas, a member bank of the Federal Reserve System, a banking institution organized under the laws of the United States and an insured bank, with intent to commit a felony, to wit, to pass, utter, and publish as true a forged check.
