This is an action of trespass on the case for negligence in which, after a jury trial in the superior court, a verdict was rendered for the plaintiff. The case is here on a bill of exceptions containing among others an exception to the trial justice’s denial of defendant’s motion for a directed verdict. On our view of the evidence that exception is decisive of the case; hence we shall not consider his other exceptions.

After reading the transcript we are of the opinion that a verdict for the defendant ought to have been directed, because on any reasonable view of the evidence he was not guilty…
