McDADE, District Judge.

Before the Court is a Report and Recommendation of United States Magistrate Judge Robert J. Kauffman [Doc. # 72]. In his Report and Recommendation, the Magistrate Judge addresses several Motions to Dismiss (Does. #34, #43, #46, #51, # 57, # 59, # 62, and # 65). The Magistrate Judge recommends that Motions to Dismiss be denied as to Count One and that the Motions to Dismiss be allowed as to Count Two.
