On January 13. 1891, the collector of customs for tbe collection district of Saluria seized'at Eagle Pass, in the state of Texas, certain five car-loads of lead and silver ores, consigned to E. H. Chichester, as forfeited to the United Beatos, by reason of certain alleged attempted false and fraudulent entries of said ores as imported goods.

The facts of this case show that precisely the same questions were at issue and passed upon by the board of general appraisers as are involved in the suit for forfeiture then and now pending in the district court for this district.
