WALD, Circuit Judge:

Carl O. Jordan appeals his conviction for possession of cocaine with intent to distribute, and possession of marijuana, on the ground that the district court erroneously failed to suppress evidence obtained in violation of the fourth amendment. After briefing and oral argument, this court retained jurisdiction but remanded the record to the district court “for clarification of the findings” underlying its legal conclusion that no seizure occurred; in particular we asked the district court to make a specific finding…
