In an action to recover damages for wrongful death and conscious pain and suffering, defendant appeals from an order of the Supreme Court, Queens County (Calabretta, J.), dated June 1, 1981, which denied its motion seeking (1) dismissal of the complaint on the ground that it was barred by the applicable provisions of the Warsaw Convention, and (2) summary judgment in favor of defendant. Order reversed, on the law, without costs or disbursements, summary judgment granted, and complaint dismissed.
