Mrs. Eileen M. Seiter was killed when the American Airlines plane on which she was a passenger crashed *164as it approached La Guardia Airport on February 3, 1959. Her administrators have brought this action for wrongful death and American has raised as an affirmative defense the limitation of liability provisions of the Warsaw Convention (49 U. S. Stat., pt. 2, p. 3000, hereinafter referred to as the “ Convention ”).
