This is a suit in equity, instituted by plaintiff, Edgar, against the defendants, Skinner Packing Company. American State Bank, and D. W. Geiselman, seeking to rescind a contract of subscription for stock in defendant packing company, cancel a note given by plaintiff in part payment thereof,and to recover $3,125,the amount paid by him on the *753subscription.
