This appeal arises out of an action to foreclose a mortgage. After the pleadings were made up the parties agreed upon a statement of facts which shows that on December 9, 1913, the plaintiff loaned to John J. Rogers and Della Rogers, his wife, $1,500 in cash, taking as evidence thereof a promissory note secured by a mortgage upon land which is now in Lake county. The mortgage was placed of record on December 15, 1913. The note was made payable three years .after date; none of the principal has been paid but the interest was kept np to December 9, 1924, the last payment having been made…
