I. INTRODUCTION
In 1998, the Yankee Candle Company (“Yankee”) sued Bridgewater Candle Company (“Bridgewater”) on five counts: 1) for violation of Yankee’s copyright on nine of its candle labels; 2) for false designation of origin under the Lanham Act, 15 U.S.C. § 1125(A); 3) for common law trade dress infringement; 4) for tortious interference; and 5) for deceptive trade practices under Massachusetts law.
