I. INTRODUCTION

This is a dispute between two companies over which company is liable for the other’s polluted groundwater.

The parties have been litigating' this case for several years, which began in the Court of Common Pleas of Lehigh County in 2014. On June 15, 2016, the parties entered into a “Tolling Agreement.” Under this contract, among other thing, the parties agreed to' discontinue the state court action.
