In 1889 the council of the City of Scranton passed an ordinance establishing the grades on certain streets including Vine Street. In 1924 an ordinance authorized the grading, paving and curbing of Vine Street, and the improvement was completed July 26, 1924. About three years after the passage of this ordinance fixing the grade, the owner, being the husband and father respectively of the plaintiffs, erected a house on the property without regard to the established grade.
