—A jury found Isaías Ramirez Romero guilty of unlawfully possessing a firearm. A trial witness commented on Mr. Romero’s constitutional right to remain silent. We conclude the comment was reversible error. In doing so, we establish a framework for analyzing direct and indirect comment issues. Additionally, we reject Mr. Romero’s challenge to the State’s failure to collect fingerprint evidence and decide the evidence was sufficient to support a conviction. Accordingly, we reverse and remand for a new trial.
