Defendant in error, as •plaintiff, commenced this action against the plaintiff in •error, as defendant, to recover on a certain life insurance policy written on the life of Coleman A. Ward, her husband. Plaintiff’s petition was filed on March 16, 1909, and Alleged that the insured, Coleman A. Ward, died on the 1st day of August, 1907, that being more'than one year before the commencement of the action. One of the provisions, of the policy sued on is that:
